IMPORTANT — PLEASE READ CAREFULLY. By registering for, accessing, or using CrewSwap, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in full. If you do not agree, you must not use this platform.
1. About CrewSwap
CrewSwap ("the Platform", "we", "us", "our") is an independent, privately operated online platform designed to assist aviation crew members in connecting with one another for the purpose of facilitating voluntary flight duty swaps and giveaways between colleagues.
CrewSwap is operated by an independent individual and is not a company, airline, aviation authority, trade union, or staffing agency. The Platform has no legal entity status at this time and operates as a personal project.
CRITICAL DISCLAIMER — NO AIRLINE AFFILIATION: CrewSwap is entirely independent and is in no way affiliated with, endorsed by, sponsored by, connected to, or acting on behalf of any airline, airline group, aviation employer, or aviation regulator, including but not limited to any low-cost carrier, full-service carrier, charter airline, or cargo operator. Any airline names, IATA codes, flight numbers, or other identifiers that may appear on this Platform are used solely for the purpose of crew members describing their own duties and are the intellectual property of their respective owners. CrewSwap makes no claim of association with any such entities.
2. Eligibility
To use CrewSwap you must:
- Be at least 18 years of age;
- Be employed or contracted as aviation crew (cabin crew or flight deck crew) by a licensed airline;
- Have the legal capacity to enter into a binding agreement;
- Not be prohibited by your employer's policies from participating in peer-to-peer duty communication platforms (you are solely responsible for checking this);
- Provide accurate, truthful registration information.
3. Nature of the Platform — What CrewSwap Does and Does NOT Do
CrewSwap is a communication and matching tool only. The Platform:
- Allows crew to post details of duties they wish to swap or give away;
- Matches users based on their stated preferences and availability;
- Facilitates direct communication between crew members;
- Records and displays swap history for subscribed users.
CrewSwap does NOT:
- Submit, process, or approve any swap, duty transfer, or trading request with any airline, scheduling system, or employer;
- Have access to any airline's internal systems, rosters, or databases;
- Guarantee that any swap agreed through the Platform will be approved by your employer;
- Act as an intermediary, agent, or representative between you and your employer;
- Provide legal, employment, or scheduling advice;
- Take any responsibility for operational outcomes resulting from swaps discussed or agreed through the Platform.
YOUR RESPONSIBILITY: Any duty swap, trade, or giveaway discussed or agreed upon through CrewSwap must be formally submitted to and approved by your airline's scheduling department through your employer's official channels. You are solely responsible for ensuring compliance with your Collective Bargaining Agreement (CBA), employment contract, company procedures manual (CPM), civil aviation authority regulations, and any other applicable rules and regulations. Failure to follow official procedures could result in disciplinary action, rostering violations, or safety consequences — all of which are entirely your responsibility.
4. User Accounts
4.1 You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with any other person.
4.2 You must provide accurate and complete information during registration, including your true name, genuine email address, correct base, and correct crew type. Impersonation or misrepresentation is strictly prohibited.
4.3 We reserve the right to suspend or terminate accounts that we reasonably believe contain false information or are being used in breach of these Terms.
4.4 You must notify us immediately if you believe your account has been compromised by contacting [email protected].
5. Acceptable Use
You agree that you will NOT use CrewSwap to:
- Post false, misleading, or fraudulent duty information;
- Harass, threaten, abuse, or intimidate other users;
- Collect personal data of other users for any purpose outside of legitimate swap communication;
- Attempt to circumvent or reverse-engineer the Platform's systems;
- Post content that is defamatory, discriminatory, or unlawful;
- Use the Platform for any commercial purpose other than the personal swap facilitation it is designed for;
- Upload malicious software, scripts, or harmful content;
- Violate any applicable law or regulation.
6. Subscriptions and Payment
6.1 CrewSwap offers a free tier and a paid Pro subscription tier. The free tier provides access to the swap board and basic messaging. The Pro tier additionally provides automatic email match notifications and access to swap history and statistics.
6.2 Pro subscriptions are available on a monthly or annual basis at the prices displayed at the time of purchase. All prices are in Euros (EUR) and are inclusive of any applicable VAT unless otherwise stated.
6.3 Monthly subscriptions renew automatically each month. Annual subscriptions renew automatically each year. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.
6.4 Payments are processed by Stripe, Inc., a third-party payment processor. CrewSwap does not store your payment card details. Your use of Stripe is subject to Stripe's own terms of service and privacy policy.
6.5 Refunds: Due to the digital nature of the service, subscription fees are generally non-refundable once a billing period has commenced. If you believe a charge has been made in error, please contact us within 7 days at [email protected] and we will review your request in good faith.
6.6 We reserve the right to modify subscription pricing with 30 days' written notice to existing subscribers via email. Continued use of the Pro tier after the notice period constitutes acceptance of the new pricing.
7. Intellectual Property
7.1 All content, design, code, branding, and materials comprising the CrewSwap Platform are the intellectual property of the Platform operator and are protected by applicable copyright and intellectual property laws.
7.2 Users retain ownership of the personal information and content they submit. By submitting content to CrewSwap, you grant us a non-exclusive, royalty-free licence to display and process that content solely for the purpose of operating the Platform.
7.3 You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without express written permission.
8. Privacy and Data Protection
8.1 Your privacy is important to us. Our full Privacy Policy, which forms part of these Terms, is available at crewswap.com/privacy and describes how we collect, use, store, and protect your personal data.
8.2 By using CrewSwap, you consent to the processing of your personal data as described in our Privacy Policy.
8.3 We do not sell your personal data to third parties. We do not share your personal data with your employer, airline, or any aviation authority.
9. Limitation of Liability
9.1 CrewSwap is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 To the maximum extent permitted by applicable law, CrewSwap and its operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use the Platform;
- Any duty swap agreed through the Platform that is not approved by your employer;
- Any disciplinary action taken against you by your employer related to your use of this Platform;
- Any breach of your employment contract, CBA, or regulatory obligations;
- Any data loss, interruption of service, or security breach;
- Any reliance on information provided by other users of the Platform.
9.3 Our total liability to you for any claim arising from your use of CrewSwap shall not exceed the amount you have paid to us in subscription fees in the 12 months preceding the claim.
10. Third-Party Services
CrewSwap integrates with third-party services including Stripe (payment processing) and email delivery providers. We are not responsible for the terms, privacy practices, or actions of these third parties. Links to third-party websites are provided for convenience only and do not constitute endorsement.
11. Termination
11.1 You may delete your account at any time through your account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy and applicable data protection law.
11.2 We reserve the right to suspend or terminate your access to CrewSwap at any time, with or without notice, if we reasonably believe you are in breach of these Terms, or for any other legitimate operational reason.
11.3 We reserve the right to discontinue the Platform entirely at any time. In the event of discontinuation, we will provide reasonable notice to active subscribers and a pro-rata refund of any unused paid subscription period.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the version number and effective date at the top of this page. Continued use of CrewSwap after the effective date of revised Terms constitutes your acceptance of those changes.
13. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Malta. Any disputes arising from or relating to these Terms or your use of CrewSwap shall be subject to the exclusive jurisdiction of the courts of Malta, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
14. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
